1. Acceptance of Terms

By downloading, installing, or using the Wishpr application ("App", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Wishpr regarding your use of the Service.

2. Description of Service

Wishpr is an anonymous chat application that allows users to:

• Connect with random strangers for text-based conversations
• Share images within chat sessions
• Optionally add chat partners as friends for future conversations
• Create and maintain a user profile with a username, bio, and gender

The Service is provided "as is" and is intended for entertainment and social connection purposes only.

3. Eligibility

To use Wishpr, you must:

• Be at least 18 years of age, or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using the App, you represent and warrant that you meet all eligibility requirements.

4. User Accounts

4.1 Account Creation

• You may create an account by providing a username and optional profile information
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and truthful information

4.2 Account Security

• You are solely responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized access

4.3 Account Suspension and Termination

• You may delete your account at any time through the App settings
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy
• Suspended (banned) accounts will be notified of the reason for suspension
• Banned users may log in to view their suspension status but cannot access other services
• Device identifiers associated with banned accounts may be recorded to prevent circumvention of bans
• You may appeal a suspension by contacting us at [email protected]

5. User Conduct

5.1 Prohibited Activities

You agree NOT to use the Service to:

• Harass, bully, intimidate, or threaten other users
• Share sexually explicit, pornographic, or obscene content
• Share content depicting minors in any inappropriate context
• Engage in illegal activities or promote illegal behavior
• Share personal information of others without consent (doxxing)
• Impersonate other individuals or entities
• Send spam, advertisements, or promotional content
• Transmit viruses, malware, or other harmful code
• Attempt to hack, exploit, or compromise the Service
• Collect or harvest user data without authorization
• Engage in discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Promote violence, self-harm, or suicide
• Share copyrighted material without authorization

5.2 Content Standards

All content you share through the Service must:

• Comply with all applicable laws and regulations
• Respect the rights and dignity of other users
• Not infringe on intellectual property rights of others
• Be appropriate for a general audience

5.3 Reporting Violations

You may report violations of these Terms through the App. We reserve the right to investigate reports and take appropriate action, including account suspension or termination.

5.4 Enforcement Actions

We may take the following enforcement actions against users who violate these Terms:

• Warning: A notification about the violation
• Temporary Suspension: Temporary restriction of account access
• Permanent Ban: Permanent suspension of account access, including:
  • Blocking all messaging and matching services
  • Recording device identifiers to prevent creation of new accounts
  • Immediate disconnection from active chat sessions
• Device Ban: Preventing the use of the same device to create new accounts

The severity of enforcement action will depend on the nature and frequency of violations. We reserve sole discretion in determining appropriate enforcement actions.

5.5 Ban Appeals

If you believe your account was suspended in error:

• You may contact us at [email protected] to submit an appeal
• Appeals will be reviewed and a decision provided within a reasonable timeframe
• If your appeal is successful, your account will be fully restored and all ban-related records will be deleted
• The decision on appeals is final

6. Subscriptions and Payments

6.1 Subscription Plans

Wishpr offers optional premium subscription plans ("Wishpr Premium") that provide access to additional features. Available plans include:

• Weekly Subscription: Billed every 7 days
• Monthly Subscription: Billed every 30 days
• Yearly Subscription: Billed every 365 days

6.2 Billing

• All subscriptions are processed through Google Play
• Payment will be charged to your Google Play account upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal cost will be the same as the original subscription price unless otherwise notified

6.3 Free Trial

• Some subscription plans may include a free trial period
• Free trials automatically convert to paid subscriptions unless cancelled before the trial ends
• Only one free trial per user/account is permitted
• If you cancel during the free trial, you will retain access until the trial period ends

6.4 Cancellation

• You may cancel your subscription at any time through Google Play Store settings
• Cancellation takes effect at the end of the current billing period
• You will retain access to premium features until the end of your paid period
• No partial refunds are provided for unused portions of a subscription period

6.5 Refunds

• Refund requests are handled by Google Play according to their refund policies
• We do not directly process refunds
• For refund requests, please contact Google Play Support or visit the Google Play Help Center

Refunds are generally not provided for:

• Change of mind after purchase
• Failure to cancel before renewal
• Unused subscription time

6.6 Price Changes

• We reserve the right to change subscription prices at any time
• Price changes will not affect existing subscriptions until renewal
• You will be notified of price changes in advance
• Continued use after price changes constitutes acceptance of the new pricing

6.7 Subscription Features

• Premium features are subject to change
• We may add, modify, or remove premium features at our discretion
• We will make reasonable efforts to notify subscribers of significant feature changes

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Intellectual Property

8.1 Our Rights

The Service, including its design, features, content, and underlying technology, is owned by Wishpr and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

8.2 Your Content

You retain ownership of content you create and share through the Service. By sharing content, you grant us a non-exclusive, royalty-free license to use, display, and transmit your content as necessary to provide the Service.

9.1 No Warranty

9.2 User Interactions

• We do not verify the identity or background of users
• We are not responsible for the conduct of any user
• You interact with other users at your own risk
• We strongly advise against sharing personal information

9.3 Availability

We do not guarantee that the Service will be available at all times or that it will be error-free. We may modify, suspend, or discontinue the Service at any time without notice.

You agree to indemnify, defend, and hold harmless Wishpr and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you share through the Service

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

12.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.

12.3 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us to attempt informal resolution.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

We will make reasonable efforts to notify users of significant changes through the App or other means.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wishpr regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
